Terms of Service
These Terms of Service ("Terms") govern your use of Polar Engine, including the web dashboard, desktop apps, API and integrations (the "Service"), provided by Polar Opposite Technologies LLC ("Polar Opposite", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service for an organization, you confirm you can bind that organization. If your organization has a signed licence agreement with us, that agreement prevails where it conflicts with these Terms.
1. The Service
Polar Engine researches how brands appear in AI answer engines, turns that research into strategy and copy, and generates images and videos. Features may change over time.
2. Accounts
You must give accurate information, keep your login details and API keys secure, and are responsible for activity under your account. Organization owners and admins manage who has access.
3. Acceptable use
You agree not to:
- break the law or infringe anyone's rights, including intellectual property and privacy rights;
- create or try to create sexual, nude or intimate images or videos of anyone, whether of a real person or made by AI, including any sexual content involving a minor;
- upload photos or video of a person you do not have the right to use;
- create misleading, defamatory, hateful, sexual or otherwise harmful content, or content that impersonates a real person or business without permission;
- upload sensitive personal data (such as health or financial data) or data about children;
- try to access other organizations' data, disrupt the Service, or get around usage limits or security; or
- resell or copy the Service except as your licence agreement allows.
4. Your content
You own the content you put into the Service and the outputs it creates for you. You give us permission to store, process and send that content to our providers as needed to run the Service, as described in our Privacy Policy. You are responsible for having the rights to the content you upload and to any accounts you connect.
5. AI output
AI output can be inaccurate or unexpected. Review everything before you publish or rely on it. We do not promise any particular result, including rankings, views or visibility in AI answers.
6. Connected accounts and ads
When you connect another company's account (such as Google, Meta, Instagram or Shopify), you also follow that platform's terms. Polar Engine only publishes content or creates ad campaigns that you approve, and campaigns are created paused. You are responsible for your ad spend and for your ads following the platform's policies.
7. Fees and credits
Paid features use prepaid credits or the fees in your order or licence agreement. Unless your agreement says otherwise, fees and credits cannot be refunded.
8. Our property
The Service, including its software, methods, playbooks and prompts, belongs to Polar Opposite. These Terms do not give you any rights to it except to use the Service as allowed here.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or end access if you break these Terms or if needed to protect the Service or others. After your access ends, you may ask for an export of your content within 30 days.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.
11. Limitation of liability
To the fullest extent the law allows, Polar Opposite is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
12. Indemnity
You will defend and compensate Polar Opposite for claims arising from your content, your use of the Service, or your breach of these Terms.
13. Changes
We may update these Terms. We will change the effective date above and, for material changes, notify you in the Service. Continuing to use the Service means you accept the updated Terms.
14. General
These Terms are governed by the laws of the state in which Polar Opposite Technologies LLC is organized, unless your licence agreement says otherwise. If part of these Terms cannot be enforced, the rest still applies.
